    Default Alex Jones' bad day

    He's in court this week, already convicted of lying and causing harm to the parents of the kids slaughtered at Sandy Hook, by maintaining for years that the shooting was "a hoax." This week's proceedings are for a jury to determine appropriate damages.

    Jones has argued this week that his business is not exorbitantly profitable, and Infowars' parent company even coincidentally declared bankruptcy this week. Huh

    Today in court, the plaintiffs' attorney produced texts, though, which suggested otherwise. When asked where they came from - as Jones had claimed that no texts or emails etc existed, the lawyer mentioned that 12 days ago, Jones' lawyers accidentally sent the entire contents of Jones' phone to them. Including voluminous texts about these and other issues, accounting documents about his business, etc.

    Oops.

    All this should have been provided during discovery, yet somehow were omitted.

    It will be fascinating, I should think, when subpoenas arrive for this phone from the DoJ, and the J6 committee.

    In the meantime, the phone's contents will have a rather unsettling impact on the jury's opinion of Jones' truthfulness and credibility. Will be interesting to see if perjury charges also follow.

    Edited to add ... the NBC story is apparently from 2019, and the images were found on documents he had forwarded to lawyers then. Not today.

    Apparently the plaintiffs' lawyer informed Jones' lawyers the same day the error occurred, and gave 10 days to indicate if anything should be considered privileged. No response.

    So 2 days ago, the content was deemed acceptable for entry into evidence. Presumably the same waiver will apply no matter who now subpoenas the content. Jones' ex wife has already said that she'll do so today, presumably pursuant to her divorce and child support rights - she's never seen Financials for Infowars either.

    This phone also holds 2 years worth of Jones' texts. I suspect J6 and DoJ will wish to review these not-privileged documents too.

    J6 committee confirms that it will subpoena Jones' texts and emails.

    Bear in mind, he apparently testified to them several months ago. Depending on what he said then, what documents he may have then given them, he maybe set himself up to be charged for lying to Congress too.

    I have been watching it - what a Train Wreck he is - eye rolls - blinking - definitely a deer in the headlights look - could not happen to a better POS. He said today that any settelment over 2 million would end his company. The prosecution attorney produced internal company emails that showed he earned $800,000/day during a CPAC convention.     Yes! And Lee is correct, and that truth is critical. Those instructions should have included a reminder of the consequences the judge is empowered to impose, and the warning that she's done talking... next step is (whatever she decides... but actual consequences). He's a very slow learner who's lived in his own delusional bubble for a long time. It WILL take more than words to pop that bubble now.

    What's the max the jury can award? Is there a max?

    This is a civil suit for money. At some point his speech was outside what is covered by the first amendment, and ought to be criminal. Perjury may land him in jail.

    The plaintiffs' lawyers suggest that Jones be fined $1 for every American whose opinion about Sandy Hook may have been influenced by exposure to Jones' repeated claims that the killings never occurred, and that the parents are all " crisis actors."

    They've found a 3rd party survey which suggests 150M Americans were exposed to that garbage.

    That's just compensation for pain and suffering. The dollar figure is before any punitive damages folks may pursue.

    Bear in mind that according to the figures on Jones' phone, during CPAC, Jones' business selling Infowars branded supplements and snake oil grossed about $800k/day.

    The wages of sin may be death, ultimately, but they're pretty steep in the interim too I suspect.

    I was just driving and listening to NPR, and they mentioned that Alex's lawyer in responding to the subpoena, sent the entire contents of his phone...

    Beau has an interesting video up. Observes that Jones is very, very connected to the upper tiers of Trumpworld. And that the privileges which all lapsed respecting whatever is on that phone will be of some .. interest .. to his pen pals about Jan6. Beau suggests that Jones' phone may become prominent in a couple of episodes of the 2nd season of the J6 show.

    I think Jones is essentially a WWE wrestler who thinks he does commentary. And that he may be able to do a "heel turn" for the ages, if encouraged enough.

    Still hope he's broken and penniless after this suit though.

    Heather Cox Richardson’s post today indicates that the family’s attorney in the case running in Texas got two years of phone records and all of Jones’ texts. Jones’ attorney didn’t declare a privilege for that information. The content is apparently devastating to both Jones and those he was in contact with - for many subjects, including the period around January 6th.

    ^ # 32 - I watched a bit of the 'replay' last night on television, when the plaintiff's attorney mentioned that he had been sent the entire content of Jone's cell phone, poor Alex got that 'deer in the headlights look' , and almost looked like he might lose his lunch.

    I'm not convinced these people know they're lying. There is something wrong in their brains such that they believe in the moment they say something that that something is true.

    The committee has done a pretty good job of proving that Trump had all the information he needed to know that he was lying. Unfortunately, the committee has still not proven that Trump "knew" he was lying.
