Sounds like some child blaming his mate for his own actions. When my boys tried it on me i'd do my best to understand the circumstances and deliver the consequences accordingly. So no I wouldn't acquit but thoroughly investigate and apply a suitable sentence.
To add a few thoughts, if there is a god, and there is no proof either way, the act would have to conform to god's nature and purpose along the lines of justice mercy healing, love, truth etc. so if the crime committed is out of god's character so to speak, then the defendant is lying or deluded. Also, to my thinking god does not make anyone do anything ever in the sense that free will exists making people responsible for their own decisions and actions resulting from where their thinking leads them. The development of conscience is an individuals responsibility after the input of parents. Obviously parental input and influence is a huge factor.

Much too simple.At least in a US court, that statement alone would not likely be sufficient for defense. Stated belief in a god, along with evidence of a life lived in accordance with that belief, might be used to show state of mind or as part of a defense.
