          So, are you two in favor of using the internet to promote child pornography? Chuck, I'm surprised you posted this, why?

          ...he went through U.S. customs knowing that he recently had used his laptop to find and view child pornography that was posted on the Internet, according to the 9th Circuit opinion. This violated the terms of his probation in Florida, where he had pleaded nolo contendre to charges of promoting sexual performance by a child and child exploitation by means of computer....

                Wrong. Convicted felons lose certain civil liberties. This guy agreed, as part of a probation deal, to not view child pornography. This wasn't a random search.

                    San Francisco-based 9th Circuit ruled that customs officials can seize and search the contents of anyone’s laptop computer, even in the absence of a search warrant or probable cause.
                    Who and what the individual was is irrelevant - anyone’s laptop computer.
                    I'd much rather lay in my bunk all freakin day lookin at Youtube videos .

                        I always know I'm on the right track when my position is attacked by extremists from the left and the right.

                        Say you crossed over the border before the invention of the computer with a sealed envelope. Custom officials had the right to search this envelope. The only exception to this customs custom was the use of the "diplomatic bag". The computer is a simple extension of the sealed envelope. Any information crossing international borders is subject to examination, read the rules pertaining to mailing something across any border in the world.

                            After reading a bit of the opinion, the court appears to have solid precedent for the idea that the govt can conduct warrantless searches at borders. The question the ABA Journal seems to ask though, is "what limits are there on such searches"? And here, the court's opinion in Romm is not much help, because Romm's argument that the search was more than the legal "routine" search, and went too far, thus violating certain of his constitutional rights, was deemed waived. The court did not address this argument because Romm had not raised it in his initial brief to the court, but only in reply to the govt's brief and the rule is that the court will only consider the arguments you raise initially.

                            So, if you accept the idea that "routine" searches at the border are legal and do not need probable cause or a warrant we will have to wait for another case to see where the limits of such searches will be found.
