Virginia attorney general and Republican gubernatorial candidate Ken Cuccinelli has challenged a court ruling that found the state's strict anti-sodomy laws unconstitutional.

Cuccinelli is asking all 15 judges on a federal circuit court to reconsider a three-judge panel's ruling against the Virginia law, which bans oral and anal sex, and which gay rights groups say is discriminatory.

The Washington Blade first reported the challenge Wednesday. It comes nearly a month after the three-judge panel ruled March 12 that Virginia's "Crimes Against Nature" is unconstitutional, citing a 2003 Supreme Court decision, Lawrence v. Texas. That ruling struck down a sodomy law in Texas and the precedent has been extended to overrule similar sodomy laws in at least 13 other states, but Virginia's law has remained on the books.

Cuccinelli has defended the law in part because it was used in 2005 to convict a 47-year-old man who solicited a 17-year old girl for sex acts. A spokesman for Cuccinelli's office said in a statement that "the attorney general is committed to protecting Virginia's children from predators who attempt to exploit them and rob them of their childhood."

That's our next Governor. I'm very excited by the by the progressive government he'll bring to the state along with his good buddy Bob Marshall. Our next goal, outlaw contraceptives, no joke. We're big on "protecting women and children" legislation here.

I wish heads of state would just go and watch some porn, and stop trying to get into everyone's fun!!! I guess if I lived in VA I would be FORCED to replace the blinds the dog shredded... The dog walkers of the neighborhood would be so disspointed :( LMAO

About a million years ago I went to a party. Was a good high school party, a bunch of us had a bit too much to drink. Somewhere in there someone got the munchies, so we all piled into the host's car. He proceeded to peel out into the main street unbeknowst to him, in front of a State Trooper. I muttered something about the judge's son (the host in fact!) and the trooper snapped too. Wasn't my intention, in fact at that point I had no intentions :D But we did get escorted to Hardees, the closest fast food joint in town. And the judge's son made it through another night. :-)

For a time it appeared Virginia might join the 20th century. We even had a powerful legislator lose his seat when he made a crack about how lowering the blood alcohol level was going to "take all the fun out of drinking and driving." Unfortunately the nitwits have regained power and we are again on the fast track to a theocratic totalitarian state.

Just to clarify - Va's sodomy law extends to those legally wed as well, so a married couple *could* be busted for oral and/or anal sex = up to 5 years in jail, up to a $5,000 fine, or both. Oh, and ladies, don't get on top = "lewd and lascivious behavior" - a misdemeanor, not a felony like busting the sodomy law.
